These terms govern your use of MetaVigil — the sensor, the app, and the metavigil.care website. Plain English. Read them.
The wellness positioning
MetaVigil is a wellness support tool, not a medical device. It does not diagnose, treat, prevent, or cure any condition. It does not replace 911, nurse-call systems, professional medical care, or human judgment. If a person is in distress, call emergency services.
Consent
You may only install a MetaVigil sensor in a space where the resident — or their authorized representative — has given informed, written consent. A consent-form template is available on request.
If you are a facility, every monitored room requires a signed consent on file before the sensor is activated.
Your account
You will create an account using Apple Sign In or a similar provider. You are responsible for who has access to it. If the account is shared or compromised, tell us at hello@metavigil.care so we can lock it.
What you may not do
- Use MetaVigil to monitor someone who has not consented.
- Use MetaVigil for surveillance, time-tracking, employee monitoring, or any purpose that isn't resident wellness.
- Reverse-engineer the sensor's firmware, attempt to bypass authentication, or use it as a vector to access other devices on the network.
- Resell MetaVigil hardware or app access without a written agreement.
What we may do
- Update firmware over the air to fix bugs and improve detection.
- Pause or limit your account if we have a credible reason to believe it is being used against these terms.
- Decline to do business with anyone we don't want to do business with.
Pricing
We are in pilot. Pricing is set on a per-deployment basis until we publish a price list. The price we agree to in writing is the price for that deployment, for the period agreed.
Liability
MetaVigil is provided as-is. We will use the system to do our best by you. We cannot guarantee that every alert reaches you, that every fall is detected, or that the device is always online. To the maximum extent the law allows, our liability is capped at what you have paid us in the prior twelve months for the deployment in question. We don't owe consequential or incidental damages on top.
Disputes
If something goes wrong, email hello@metavigil.care first. We will try to make it right. If we can't, formal disputes are governed by the laws of the State of Kansas, with jurisdiction in Sedgwick County.
Changes
We may update these terms. If we change them materially, we will let active customers know by email. The date at the top of this page reflects the current version.
